- A jury found that a furniture company must pay restitution for lost income and injuries to a 67 year old truck driver when the furniture company didn’t load a trailer safely. The truck driver was required to unload the trailer by himself, suffered a shoulder injury and was unable to work again at the only job he had done during his life ... driving a truck. The furniture company manager said the furniture company did not consult a safety expert to develop a procedure to safely load furniture to keep truck drivers safe because “safety experts are a dime a dozen”.
- A 46 year old truck driver, his wife and children were provided for following a pelvic injury suffered by the truck driver when a paper company did not follow OSHA forklift safety procedures on its loading dock and a one ton bale of paper fell on the truck driver crushing his pelvis.
- Nothing can make up for their loss, but the insurance company for a tour bus company was forced to pay a fair settlement to the wife and three children of a 37 year old service technician who was killed when a tour bus was lowered while the husband and father was changing a wheel on the bus. The bus manufacturer said the only way the bus could have been lowered was for someone to push the button to lower the bus. The tour bus owner denied that anyone pushed the button.
- After visiting their family and returning home on Easter, a 45 year old father was killed and his wife seriously injured when a driver crossed over onto their side of the road and hit them head on. The vehicle that hit the father and mother head on was owned by a towing company. After a lawsuit was filed against the towing company, the insurance company for the towing company paid the policy limits.
- A jury found that a surgeon and his practice group had to pay restitution to a military veteran when the surgeon performed a wrong level spinal fusion on the veteran. The veteran found out from another surgeon that the fusion was done at the wrong spinal level. The jury also found that the surgeon and practice group had to pay back the insurance company that paid for the wrong level spinal fusion. It is believed this is the largest medical malpractice verdict in this East Tennessee city.
- A 50 year old salesman was rear ended while on the job. The salesman suffered a back injury and began having trouble remembering things. The memory problem was diagnosed as a closed head injury. A lawsuit was filed and fair settlement reached for the workers compensation claim and the claim against the negligent driver that rear ended the salesman.
- Although nothing will ever make the pain for the loss of their son go away, the parents of an 18 year old high school student who worked part time after school at a local country club received some satisfaction when a local country club had to accept responsibility after denying any responsibility for their sons death. After a lawsuit was filed, the country club was forced to accept responsibility and pay a fair settlement for its negligence after the country club permitted a 16 year old, 17 year old and two 18 year old part time employees to take one golf cart to play golf after the country club was closed. The country club admitted it was “foreseeable” that the kids would ride more that two on the cart and could be injured. The parents 18 year old son suffered a head injury and died when riding on the back of the golf cart.
- A 54 year old grandfather was killed when he, his grandson and son-in-law were taking a weekend drive and their vehicle was broad-sided by a driver being chased by a police officer with flashing lights and siren. The police officer was chasing the driver because the driver was speeding. A lawsuit was filed and during the discovery process it was found out that the police department did not have an adequate pursuit policy, nor was the policy it did have adequately communicated to its police officers. After denying any responsibility, the police department was forced to pay a fair settlement to the family, grandson and son-in-law.
